What’s the meaning of better parent in child custody cases?

When parents decide to divorce, there are many things they need to sort out. One of the most important details that needs to be discussed is that of child custody. Florida courts are pretty clear when they ask parents who are fighting for sole custody for proof the kids would be better off with them, and this is called the better parent standard. 

Provide proof 

This is a far cry from joint custody since, in these instances, one or both parents are asking a family court judge to keep one parent from taking care of the children after a divorce is final. Judges usually believe joint custody is better for children, but in certain cases, it may not be. If both parents want sole custody, the judge will ask them to show how they are a better parent than their former spouse. 

What’s best? 

One of the major earmarks a family court judge will use to make a custody decision on what he or she perceives is what is in the best interests of the children. The judge has to see that the children would be better off with one parent rather than the other or both. Evidence must be documented and could include that the children may be in danger if left with one parent, rather than the other. Parents may also be asked to provide proof of income and plans for a child’s future as well. 

Even when a parent believes he or she has all the proof needed to present to a family court judge, it is important to enlist the help of a Florida lawyer with experience in child custody cases. It is vital to know what to expect and what to do in court. Also, having a firm grasp of the better parent standard is crucial for presenting the right evidence in court.
