Taking the amicable approach to divorce

On Behalf of Law Office of Timothy S. Keough, P.A. | Apr 6, 2022 | Divorce

In coming to the realization that a marriage is at its end, most people don’t want it to be riddled with contention and drama. Instead, Florida couples can make a conscious decision to divorce being as amicable as possible. When the focus is kept on legal matters rather than on emotion, making decisions as smoothly as possible could be the outcome. A civil divorce is much easier on everyone involved, thus making the effort to maintain a respectful relationship can be critical toward a much-easier transition into the future.

Tips for amicable communication

Determining what each party wants is the first road to maintaining civil communication. This should include discussions regarding the marital assets, custody arrangements if children are involved, spousal support and/or child support if applicable, and much more. Some particular behaviors that can prove invaluable to the cause include the following:

  • Maintaining a level of respect for a soon-to-be former spouse and expecting the same level of respect from him or her
  • Understanding that goals may have to change as negotiations proceed
  • Trying to allow logic to fuel decisions rather than any hard feelings that may exist toward a spouse
  • Considering how your actions will affect the children

Keeping emotions in check is not always easy during these times, but making an effort to keep a level head and remembering these goals above might be helpful.

Choosing litigation if an amicable divorce isn’t possible

The reality is that in spite of everyone’s best wishes, some Florida couples who set out to end their marriages in an amicable manner are not always able to complete the process that way. In the event negotiations come to a halt, or if one spouse believes the other is acting unfairly, divorce litigation options may be necessary. Either way, an experienced lawyer can carefully guide a divorcing individual through this challenging process, providing much-needed peace of mind and increasing the odds of achieving the best possible outcome.
