What is the divorce process in Florida?

Divorce can feel overwhelming, but understanding the process helps you stay in control. Florida has specific steps that guide how a divorce moves forward, and knowing them makes things clearer. Whether your case is simple or complex, the process follows the same general path.

Filing the petition

The process starts when one spouse files a petition for dissolution of marriage with the court. This document states that the marriage is broken and asks the court to divide property, debts, and possibly set arrangements for children. The spouse who files is the petitioner, and the other becomes the respondent. The respondent must receive the papers formally to begin the case.

Response and temporary orders

Once served, the respondent has time to file a written answer. If children, property, or financial support are involved, either spouse can request temporary orders. These orders set rules for custody, child support, or financial responsibilities while the divorce continues. Temporary orders stay in place until the court issues the final divorce decree.

Financial disclosure and negotiation

Both spouses must complete financial disclosure forms. These documents list income, expenses, assets, and debts. The law requires full disclosure so the court can decide property division and support fairly. After exchanging this information, many couples work to reach an agreement through negotiation or mediation. If they agree, the court reviews the settlement and approves it.

Trial and final judgment

If the spouses cannot agree, the case moves to trial. Each spouse presents evidence, and the judge decides on property division, support, and custody. After reviewing all issues, the judge issues a final judgment of dissolution of marriage. This judgment legally ends the marriage and sets the terms both spouses must follow.
